1. Definitions
In this TOS:
“Account” refers to the account you will be required to create on the Site to enable access to certain pages and features, and to submit an Order.
“Business Day” refers to any day that is not (i) a Saturday or Sunday, (ii) a public holiday, or (iii) a bank holiday anywhere in India.
“Contract” refers to your Order of Product(s) in accordance with these Terms and Conditions, accepted as per Clause 7.2.
“Customer” refers to any individual who places an Order on the Site.
“Order” refers to an online purchase made via the Site to buy Product(s) in accordance with these Conditions.
“Product(s)” refers to any product listed on the Site for sale.
“You” refers to the Customer placing an Order on the Site.
References to “clauses” refer to clauses in these Terms and Conditions. Headings are for ease of reference only and do not affect the interpretation. Words in the singular include the plural and vice versa. Gender references include all genders. Terms like “includes,” “including,” etc., are not to be interpreted as limiting.
2. Eligibility
To make purchases on the Site, you must be at least 18 years old. If under 18, your parent or guardian must consent to the site’s Privacy Policy. Shree Hari Creation reserves the right to accept orders only from those over 18 years old.
3. Prohibitions
You are responsible for all your activity on the Site. Engaging in prohibited behavior or misuse may result in denial of access, with breaches possibly reported under applicable cybersecurity laws.
4. Intellectual Property Rights, Software, and Site Content
i. Use of the Site grants no rights over any intellectual property.
ii. Unauthorized reproduction or redistribution is prohibited and may result in legal action.
iii. “Content” includes all site visuals, audio, text, and media.
iv. We do not guarantee the Site or its Content is error-free or virus-free.
v. The Site is for personal, non-commercial use only.
5. Third-Party Rights Disclaimer
All trademarks, images, and third-party content on this Site are protected and used only for identification or description purposes.
6. Entire Agreement
These Terms and Conditions form the full agreement between you and Shree Hari Creation, superseding all prior communications.
7. Terms of Sale
7.1 Registration
To purchase, you must register with accurate, current information and be authorized to use the provided payment method.
7.2 Acceptance of Order
All Orders are subject to acceptance. Order confirmation emails are acknowledgments, not confirmations. The sale is confirmed when a dispatch email is sent. We may reject any order at our discretion.
7.3 Price and Payments
Prices are in INR and include applicable taxes. Prices shown in other currencies are indicative. Final charges may vary based on your card’s exchange rate. All promotional offers must be applied before checkout.
You authorize Shree Hari Creation and its payment provider (e.g., Razorpay) to process your payment. All payments are subject to provider terms. We are not liable for payment issues caused by third-party providers.
7.4 Product Availability and Descriptions
Products are subject to availability. Visuals and specifications are approximate due to display differences or material characteristics.
8. Delivery
We cannot deliver to PO Boxes or military/protected areas. Customs inspections may delay delivery. Delivery dates are estimates and not guaranteed. Refer to our Shipping & Tracking section for more.
9. Acceptance of Products
Returns must be initiated within 7 days of receipt. Products must be unused and in original condition. Return costs are the customer’s responsibility unless specified otherwise. Defective products must be reported with photos via your account within 7 days.
10. Store Credits
Store Credits may be issued for returns and are valid for 3 months. Orders placed using Store Credits are not eligible for further returns.
11. Limits of Liability
We are not liable for indirect or unforeseeable losses or failure due to circumstances beyond our control.
12. Indemnity
You agree to indemnify and hold harmless Shree Hari Creation and its associates from claims arising out of your breach of the TOS.
13. Relationship
No agency, partnership, employment, or joint venture relationship exists between you and Shree Hari Creation as a result of using this Site.
14. Waiver
If we fail to act on a breach by you, we are still entitled to enforce our rights at a later time.
15. Governing Law
These Terms shall be governed by and construed in accordance with Indian law. Courts in India shall have exclusive jurisdiction.
16. Variation
We reserve the right to modify these Terms. Continued use of the Site constitutes acceptance. Changes will not affect orders already placed.
